בקרוב תדון הכנסת בהצעת חוק שלפיה לא יועברו הילדים אוטומטית לחזקת האמא במקרה של גירושים. עו"ד אירית רוזנבלום מארגון "משפחה חדשה" טוענת: "המצב כיום מסוכן ומנציח את האישה כעקרת בית דיכאונית ומתוסכלת"

בימים אלה הוצגה הצעת החוק מטעם ח"כ יוליה שמאלוב-ברקוביץ', המבקשת לבטל את "חזקת הגיל הרך" . "חזקת הגיל הרך" קובעת שילדים להורים שהתגרשו ולא הסכימו ביניהם מי יגדל את הילדים, יגדלו אצל האם בלבד עד הגיעם לגיל שש.
ח"כ שמאלוב-ברקוביץ' מנמקת את הצעתה לתיקון המצב בטענה שהחוק הקיים אינו רגיש דיו לטובת הילד, אולם ברור לכל כי סעיף חזקת הגיל הרך פוגע בעיקר בנשים והוא אנטי-פמיניסטי בעליל.

המצב החוקי השורר כיום, שבו חזקת הגיל הרך אצל האם, מנציח לצערי את הפטרנליזם והשובניזם הגברי ואת מעמדה של האישה כעקרת בית. זוהי השקפת עולם מסוכנת העשויה לפגוע בתפיסת העולם המבקשת שוויון הזדמנויות מלא.
אישה הנדרשת לגדל את ילדיה באופן בלעדי היא אישה שאיננה פנויה לפתח קריירה, להיאבק על זכויותיה ולהיות שווה בין שווים. זו אישה שעשויה להיות לא טובה לילדיה, חסרת סיפוק, דיכאונית ומתוסכלת. בהנצחת מעמדה כעקרת בית, תהא דרכה לשוויון ארוכה יותר.
עקרת בית שאינה עושה זאת מבחירה, אלא מכוח חוק הקובע את חזקת הגיל הרך, איננה אישה עצמאית המקבלת החלטה פרטית אלא מי שנכפה עליה לבצע תפקיד ל"נשים בלבד".
