רגע לפני שטסים לחו"ל יש גם פתרון אזרחי לנישואין בישראל – ארגון משפחה חדשה מסייע ומייעץ למי שאינו מעוניין או אינו יכול להתחתן באמצעות הרבנות.

מהי משפחה? / עו"ד אירית רוזנבלום

הסוגיה מהי משפחה אינה מעוגנת בחוק הישראלי. עו"ד אירית רוזנבלום טוענת כי לכל אדם הזכות להקים משפחה ללא קשר לדת גזע או מין. דבר שאינו מובן מאליו בישראל, כיוון שהמשפחה המוכרת בפני החוק בישראל הנה אך ורק משפחה הטרוסקסואלית, כששני בני הזוג הם יהודים ונישואיהם הם כאלה התקפים בפני הרבנות, או משפחה אזרחית כששני בני הזוג אינם יהודים.

התופעה
גם בשנת 2006 חלה עליה קלה בתביעות הגירושין. עם זאת ביחס למספר התושבים בישראל מדובר במצב של ירידה מתונה השיעור ההולך ופוחת בשיעור הגירושין, הוא תוצאה ישירה של פיחות הולך וגובר בשיעור הנישואין, ואנו צפויים להמשך הירידה. העולם כולו עובר מהפכה בחיי המשפחה והזוגיות, חלה ירידה דרמטית בשיעור הנישואין. אנו עדים לכך שבמדינות מערב אירופה אחד מתוך שני זוגות אינו מתחתן, כך שלמעשה אין יותר מי שיתגרש." יחד עם זאת "ישראל תופסת את המקום ה 27 בעולם באחוז הנישואין המסתיים בגירושין (26%). בילרוס ובריה"מ הן המדינות המובילות את שיעור הגירושין בקרב המתחתנים עם 68% (עליה של 2%) לעומת שנה קודמת אחריהן שבדיה 64% לטביה 63% אנגליה עם 53% ארה"ב 49% קנדה 45% גרמניה 41% וישראל עם 26% . לדברי עו"ד רוזנבלום, "שנות הנישואין הקריטיות הן השנים השנייה עד הרביעית בשנים אלו מתרחשים מרבית מקרי הגירושין, מעל 8% מן הנישאים, מתגרשים דווקא בשנת נישואיהם השלישית".
