מהקמת בנק זרע לחיילים ועד למאות שכבר ביקשו ילדים באמצעות "צוואה ביולוגית"

כ- 350 איש בישראל כבר הפקידו צוואות ביולוגיות שבהן אישרו להשתמש בזרעם לאחר מותם. ידיעות אחרונות 12.8.08

בשנים האחרונות מקדם ארגון "משפחה חדשה", בראשות עו"ד אירית רוזנבלום, את הצוואה הביולוגית – בקשתם של אנשים להקפיא תאי זרע או ביצית כדי לאפשר העמדת צאצאים לאחר מותם.

הצוואה הבילוגית עלתה לסדר היום בפרשת מותו של החייל קיוון כהן, שנהרג ב- 2002. לפני מותו הוא הספיק לבקש מהוריו שאם יקרה לו דבר מה, הם ידאגו להביא ממנו צאצאים לעולם. בית המשפט אישר את הבקשה. "בעקבות המקרה הזה פרצנו דרך חדשה. ישראל היא כנראה המדינה הראשונה בעולם שהתייחסה לנושא בהנחיות מפורטות", אמרה עו"ד רוזנבלום.

על פי הנחיות היועץ המשפטי לממשלה אפשרי כיום שימוש בזרע הנפטר בעיקר עלידי מי שהייתה בת זוגו. עם זאת, בתביעה שניהל "משפחה חדשה" ניתן בראשית 2007 פסק דין שאישר קיום צוואותו של חייל על ידי הוריו, שביקשו לאפשר לאישה שלא הייתה בת זוגו של החייל לשמש אם לתינוק מזרעו.scan0003

עוד בשנת 2001 יזמה עו"ד רוזנבלום את הקמתו של בנק זרע לחיילים שבו יוכלו בין היתר חיילים להקפיא את זרעם לצורך שימוש בעתיד, במקרה שבו ימצאו את מותם במהלך השירות.

 

עם פרוץ מלחמת לבנון השנייה הקים ארגון "משפחה חדשה" את בנק הצוואות הביולוגיות. הצוואה נערכת על ידי עורך דין מטעם הארגון. "רעיון הצוואה הביולוגית נועד להגן את זכותו הבסיסית של כל אדם להביא לעולם צאצאים ולהעמיד דור המשך לעצמו גם לאחר מותו" "אמרה עו"ד רוזנבלום.
